“I refuse to join a decision that effectively denies defendants who commit offenses while mentally ill an opportunity to present to the jury an insanity defense,” Dooley wrote in a dissent longer than the majority opinion. “Notwithstanding the brutal and senseless nature of the offense committed in this case, we must not forget that it is as much the duty of the state to protect an insane man from conviction as it is to prevent a sane man from escaping that result.”
